The customer must have read and understood these Terms and Conditions before placing an order. By placing an order, the customer accepts these Terms and Conditions in their entirety.

General clause

Our sales are subject to the present General Terms and Conditions, which shall prevail over any conditions of purchase, unless expressly waived in writing by us.

Scope of application
|
These general terms and conditions of sale apply irrespective of the type of order placed by the customer: online order, mail order, etc.

|
Orders
|
Orders can be sent by post, by Internet or by telephoning our Sales Department directly. We will dispatch the items on the order to the address given by the customer. In the case of on-line orders on the www.lewineclub.com website, the order is considered irrevocable from the last "acceptance click" and can only be challenged in the cases set out below. A confirmation e-mail is sent once the order has been registered. By keeping this e-mail and/or printing it out, the customer has proof of his order, which we recommend keeping, as only the information contained in this confirmation e-mail will be deemed authentic in the event of a dispute.
By sending the order form, the customer authorizes vinsplusvins to debit the customer's payment card for the total amount of the order. The validated order is considered effective only when the banking payment centers concerned have given their approval. In the event of refusal by the said centers, the order is automatically cancelled.
All orders are subject to payment.
The information provided by the purchaser when placing an order is binding: in the event of an error in the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product. Orders are definitive only when they have been confirmed by the payment of the price by the buyer. All our offers are subject to availability, without obligation, and are subject to sale.
Considering the rare or speculative nature of certain products, restrictions on available quantities may be applied. In such cases, the quantity available is limited per household (same name, same address, same e-mail address, same account or credit card holder). We therefore reserve the right to refuse an order if there is any doubt about the existence of a previous order for such a product. We reserve the right to cancel or refuse orders from professional customers. This contract is governed by French law. The courts of the registered office of vinsplusvins (Bordeaux) shall have exclusive jurisdiction.

Prices, terms of payment
|
Prices are given in euros, all taxes included. Amounts expressed in other currencies are given for information only. The price indicated on product sheets does not include transport. The price indicated in the order confirmation is the final price, expressed inclusive of all taxes and including VAT at 20% for France. This price includes the price of the products, as well as the costs of handling, packaging, storage and transport of the products. The prices indicated include all taxes (VAT, except for typographical errors) for Metropolitan France (including Corsica) (VAT at 20%), but exclude transport. Orders are payable in cash. No product will be delivered until payment has been received. In addition to the net price of the goods, the invoice will show additional services: packaging, shipping, 48 or 72-hour service, as well as the VAT in force at the time the invoice is issued. The prices quoted on www.lewineclub.com apply only to orders placed on the Internet. We reserve the right to modify our prices at any time, but products will always be invoiced on the basis of the rates in force at the time orders are registered, subject to availability.

Validity of professional offers received by post
|
Customers may receive promotional offers by post, giving them access to special purchasing conditions. These offers are subject to specific conditions indicated in the document containing the offer (e.g. order code). Under no circumstances may they be combined with other promotions running on the website.

Right of withdrawal (consumer customers only)
|
The consumer customer has a period of fourteen (14) clear days from delivery of the order to return the product. Returns must be made in their original, complete condition (packaging, accessories, instructions 2026), enabling them to be marketed as new. Within this period, the customer will have the option of requesting either a refund of the sums paid. The product must be returned in perfect condition in its original packaging. The customer is solely responsible for the cost of return transport. Any refund to the customer will be made within fourteen (14) days of exercising this right. The retraction request must be sent to the company's head office by registered mail.

Late and non-payment
|
In the event of non-payment by the customer of any sum due to us, we reserve the right, without the need for prior notice, to suspend all deliveries to the customer until the latter has paid the sum or sums due. Should legal proceedings prove necessary, the customer will bear all costs incurred in recovering the sums due. It is expressly agreed that failure to pay by the due date will result in the immediate payment of all outstanding sums, regardless of the method of payment initially agreed, as well as, by way of late payment penalties, an indemnity equal to one and a half times the legal interest rate, in addition to any procedural costs. Wines remain our property until invoices have been paid in full.

Delivery times, returns, disputes, complaints
|
In principle, our orders are dispatched within 2 to 6 days. However, as we work with other delivery partners, we cannot guarantee this lead time, which is given merely as an indication. The customer acknowledges that he/she is aware that products are delivered by post. We strongly recommend that customers check their parcels in the presence of the deliveryman. In the event of material damage, the customer must note this on the deliveryman's receipt. In the event of non-delivery, the customer is requested to inform our Sales Department within 2 weeks of placing the order.
Wines are delivered in wooden crates or cartons of 1, 2, 3 or 6 bottles, and can be delivered to the same place at the same time. We undertake to do our utmost to deliver the products ordered as quickly as possible. Average delivery times are specified and vary according to the destination country chosen by the customer. Delivery is made within the agreed time by handing over the product directly to the stated recipient, or in the event of absence, by notification of availability. Any delays do not entitle the purchaser to cancel the sale, refuse the goods or claim damages. Goods are always transported at the recipient's risk. Always check your parcel on arrival. You have 48 hours to make any reservations with the carrier in the event of shortage or damage.

Force Majeure
|
The following are expressly considered to be cases of force majeure, in addition to those usually accepted by the jurisprudence of French courts and tribunals: total or partial strikes (internal or external to the company), bad weather, epidemics, blockage of means of transport or supply for any reason whatsoever, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, legal or regulatory changes to forms of marketing, total or partial blockage of means of telecommunications and communication, including networks and services, and any other cases beyond the express control of the parties and preventing the normal performance hereof.

File protection
|
The information collected when ordering a product is necessary for delivery and for sending documents relating to the product. D°VIN may transmit this information to its contractual partners. THE CUSTOMER ACKNOWLEDGES HAVING BEEN INFORMED THAT, IN ACCORDANCE WITH THE PROVISIONS OF LAW NO. 78-17 OF 6 JANUARY 1978, KNOWN AS THE "INFORMATIQUE ET LIBERTES" LAW, HE/SHE HAS THE RIGHT TO ACCESS, RECTIFY AND OBJECT TO HIS/HER PERSONAL DATA BY SENDING A LETTER TO D.VIN.

Disputes
|
Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to explain their situation. In the event of a dispute, the customer should first contact the company for an amicable solution. All disputes will be governed by French law.

Legal information

Minors: by virtue of Ordinance no. 59-107 of January 7, 1959 and Law no. 74-631 of July 5, 1974, the sale of alcohol to minors under the age of 18 is prohibited.
